Lawyers of PARITET law firm have defended the Client’s interests in Kyiv Court of Appeal in the case of property rights protection to premise in the object of cultural heritage

The Client is the owner of an object of social and cultural-mass purpose, which is located in the landmark in historical center of Kyiv.

Owner of the adjoint premises has conducted illegal construction work without obtaining appropriate permits and project documentation approval. Illegal construction limited the ability to freely use of the premise, owned by the Client.

For the purpose of property rights protection PARITET law firm filed a lawsuit in court seeking the demand to dismounting and illegal building prohibition.

In spite of judicial proceeding, illegal construction work has not been terminated; the landmark in the center of the capital continued to be destroyed.

Thereby lawyers were reluctant to apply for adoption of measures for security of a claim and construction work suspension till the hearing of the case. Considering the threat to the object of cultural heritage, the court has prohibited the conduction of construction work till the dispute resolution.

PARITET law firm has proved that construction work has been conducted without appropriate project and permit documentation. On that ground the court of the first instance had satisfied claims under the lawsuit in full. The same decision had been affirmed by Kyiv Court of Appeal.
